General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders, deliveries and services provided by Tanak WOUX, Tellistrasse 64, 5000 Aarau, Switzerland, placed via the online shop www.woux.ch.

By submitting an order, the customer agrees to these GTC.

3. Conclusion of Contract

The presentation of our products in the online shop does not constitute a legally binding offer.

By completing the ordering process, the customer makes a binding offer to purchase the selected products.

The purchase contract is only concluded once the order is confirmed by Tanak WOUX or the goods are shipped.

If a product is not available upon receipt of an order, we will inform the customer as soon as possible. Any payments already made will be refunded immediately in this case.

4. Prices

All prices are stated in Swiss francs (CHF).

Unless otherwise stated, all prices include taxes and duties calculated by Tanak WOUX.

Shipping costs are stated separately during the ordering process.

For deliveries to selected European Union member states, shipping is generally carried out under the DDP (Delivered Duty Paid) or IOSS (Import One Stop Shop) procedure.

Where these procedures are applied, the customer will generally incur no additional import duties or customs fees upon proper delivery.

If additional costs arise due to changes in law, official orders, or incorrect or incomplete information provided by the customer, these may be charged to the customer in accordance with applicable statutory provisions.

5. Payment Methods

The following payment methods may be offered:

Payment processing is carried out by certified payment service providers. Tanak WOUX does not store complete credit card or payment data.

6. Delivery

Delivery is made to the delivery address provided by the customer.

All orders are processed and shipped within 1–2 business days of receipt of payment.

After handover to the shipping service provider, the estimated delivery times are:

Switzerland: 1–2 business days
Germany: 3–5 business days
Other EU countries: 3–5 business days

The delivery times are in addition to the processing time of 1–2 business days.

All delivery times are non-binding estimates.

Delays due to force majeure, official measures, customs clearance, strikes, or other unforeseeable events do not give rise to a claim for damages.

7. Retention of Title

Until full payment has been received, the delivered goods remain the property of Tanak WOUX.

8. Quality Promise

Every product is carefully inspected before shipping.

Our aim is to offer high-quality denim products with precise workmanship, selected materials, and timeless design.

If a manufacturing defect exists despite careful quality control, please contact our customer service at info@woux.ch.

9. Right of Withdrawal

Customers have the right to withdraw their order within 14 days of receiving the goods.

The goods must be unworn, undamaged, and clean, and must include all original labels and original packaging.

Products excluded from return are those whose return is excluded for hygiene reasons or due to statutory regulations, or whose condition has been altered after receipt.

10. Returns

Returns must be registered within the withdrawal period.

The goods must be carefully packaged and sent to the return address provided by Tanak WOUX.

For orders with a delivery address in Switzerland or Germany, return shipping is free of charge. No processing or restocking fees will be charged for the return.

For orders with a delivery address in other countries, the customer bears the immediate costs of return shipping, to the extent permitted by law and unless expressly agreed otherwise.

11. Warranty

The statutory warranty rights under applicable law apply.

Obvious transport damage or defects should be reported immediately upon receipt of the delivery.

Damage caused by normal wear and tear, improper handling, incorrect care, accidents, or improper use is excluded from warranty.

12. Liability

Tanak WOUX is liable in accordance with statutory provisions.

To the extent permitted by law, liability for indirect damages, consequential damages, lost profits, or other financial losses is excluded.

This limitation of liability does not apply in cases of intent, gross negligence, or cases of mandatory statutory liability.

13. Data Protection

Personal data is processed in accordance with the current Tanak WOUX privacy policy.

14. Intellectual Property

All content on this website, including designs, photographs, graphics, texts, logos, trademarks, and other content, is protected by copyright or trademark law.

Any use, reproduction, or publication outside the statutory limits requires the prior written consent of Tanak WOUX.

15. Applicable Law

These GTC are subject exclusively to the substantive law of Switzerland, excluding conflict of laws provisions, unless mandatory statutory provisions to the contrary apply.

16. Jurisdiction

To the extent permitted by law, the exclusive place of jurisdiction is Aarau, Switzerland.

Mandatory places of jurisdiction under applicable consumer law are reserved.

17. Severability Clause

If any individual provisions of these GTC are invalid or unenforceable in whole or in part, or become so, the validity of the remaining provisions shall remain unaffected.

In place of the invalid provision, the legally permissible provision that comes closest to the economic purpose of the original provision shall be deemed agreed upon.

18. Amendments to the GTC

Tanak WOUX reserves the right to amend these General Terms and Conditions at any time.

The version published on www.woux.ch at the time of ordering shall apply.
